Getting a Subclass 461 Visa After Your Relationship with Your NZ Partner Has Ended

If your relationship with your New Zealand (Kiwi) partner has ended in separation or divorce, you may still be eligible to apply for another Subclass 461 New Zealand Citizen Family Relationship Visa to stay in Australia. However, there are important conditions you must meet.

1. No New De Facto or Married Relationship

To qualify for another Subclass 461 visa after your breakup, you must not have entered into a new de facto or married relationship—even if that new relationship has already ended.


2. Your Last Visa Must Have Been a Subclass 461

You must ensure that your last visa was a Subclass 461 visa and that you do not currently hold another visa (except for a Bridging Visa).


3. Applying from Outside Australia

If you are applying from outside Australia, you may still be eligible, but you must meet specific requirements, including:

  • A minimum period of time spent on a Subclass 461 visa in Australia

  • A maximum amount of time spent outside Australia before applying


4. Substantial Ties to Australia

You will need to demonstrate substantial business, cultural, employment, or personal ties to Australia that benefit the country.
