NZ citizens who arrive in Australia are given a subclass 444 Special Category Visa at the airport. Although this visa is temporary it allows holders to stay in Australia indefinitely.
A child born in Australia after 1 July 2022 to a subclass 444 holder will be Australian. This means they only need to apply for evidence of Australian citizenship, as they are born Australian.
If you were born in Australia between 1 September 1994 and 26 February 2001 and your parent held a subclass 444 visa then you will also be Australian.
All people born in Australia after 20 August 1986 to a parent who held a permanent visa are Australian citizens. So if you were born to a NZ who obtained a permanent visa (for example a subclass 189 visa) then you will be Australian.
If your situation is not covered in this blog post, contact us to find out whether you might be an Australian citizen.
