There has been much talk, speculation, and some anxiety regarding the proposed changes to the temporary skill shortage employer sponsored visa. The government advertised these changes and there was some thought they would start on 23 November 2024.
However the Australian parliament has now finished for this year, and although they passed a very large number of bills, the Migration Amendment (Strengthening Sponsorship and Nomination Processes) Bill 2024 was not one of them. The government intends on sitting again in February 2025, which means that there can be no legislative changes until then. There is even some speculation that the government will not have time to sit and pass this legislation before the upcoming 2025 federal election.
The proposed changes to this visa subclass include a name change to the “skills in demand” visa; changing the occupations that are currently on the list; and creating a register which allows people to see which companies are currently able to sponsor people on subclass 482 visas.
However we do not know exactly what the changes will be, or who they will effect, or when they will happen.
As always with immigration law, the only certainty is uncertainty.
The good news is that if your occupation is currently on the list, you still have time to lodge a subclass 482 visa. An important thing to consider when applying for this visa is that your employer must advertise the position for at least 4 weeks before you can apply, so if you do wish to apply for this visa and the position has not been advertised yet there is still time to do so. Keep in mind that the requirements for how the position is advertised are very strict.
